I have some doubts regarding of ESIC and WC policy
1. Can we take ESIC and WC policy both for contract workman?
2. Can we take benefit from both policy within the same time in fatal accident?.
3. Will be applicable claim from both policies?.

Once an employee is covered under ESI, he cannot claim same benifit under the Employees Compensation Act or any other Act or under any different scheme.Other views welcome.

Dear..
As per the Act if one is member of ESIC it absolves the mandatory requirement of Employees compensation act and Maternity benefit act. However where ESIC is applicable it is mandatory to become member of ESIC. Both are contributory schemes hence as per my understanding there should not be any bar for benefits in case of fatality, however the finality shall be checked with detailed terms of the WC policy.
