Hello is it right to mention in appointment letter that if sales targets are not achieved then salary will be withheld or not given.Does mentioning the same in appointment letter hold in favor of employeer as he has mentioned the same and is accepted by employee, or it is not valid, as no body is given right to withhold the salary earned by an employee his services rendered. What is the case then for sales people. Is variable held. Constant has to be given as per attendance , right...?
Also another clause mentioned in appointment letters, that if ant matter arises then same will in the jurisdiction of XXX court. So does it really matter or is it the free will of employee that he /she can apply anywhere. Jurisdiction in regards to civil court. But if we are going through labour court ,does it apply.... subject to condition.

Salary cannot be withheld.
Incentives can be withheld if target not met.
If legal dispute arises,employee will be bound by the agreement which lays down jurisdiction as normally the company HO will be located at the same place.
