We had three employees under ESI. 2 of them left in May 18 and June 18. The 3rd one had got an increment in May 18 and her current gross wages is Rs. 25,064.00.
As per rule, we will deposit her ESI upto September 2018. Kindly advise what do we need to do after September 2018.
Do we need to file monthly return? If yes, please advise the procedure.
Can we surrender our ESI registration?

You need to submit nil return after Sept 18 if you wish to continue ESI code. But as there is not option like NIL report please visit your nearest ESI regional office for the same.

Though the I P got increment, she would be contributory only up to September '18. As such, for the October '18 return you can exclude her.
Within the half yearly period of April- September/ October- March, exclusion is not possible. So the single employee would remain contributory on gross wages earned till sept 30, 2018


Thank you for your reply. Yes I will exclude the employee in October 18 with code 4-Out of Coverage. Do we have a separate format for NIL RETURN (Monthly) ? Or same form will work? Please advise.

after making exit , just write a simple letter to ESIC regional office and submit to them and get stamped acknowledgement,
for furture communication this record will be firewall to any unwanted trouble

This is to inform you that at present we do not have any employee in gross wages range of 1-21000 (eligible limit), so we shall not file monthly contribution from nov 18 onwards ( oct 18 contribution sheet is enclosed herewith)
as NIL returns are not accepted by ESIC so grant us this facility not to file the returns when the liability is NIL
Whenever it would be payable or any employee is recruited under the criteria, we promise shall start submission of monthly return

We are a newly registered unit and having 13 employees. Out of this 6 employees are getting a gross salary of Rs. 25000 each. Whether we have to register under ESI Act and deduct the ESI contribution for all.
