One of our employees promised us to serve a minimum of 2 years in our company and he received training. Now, he has informed us that he is leaving the company without giving any notice. Can anyone suggest whether I should draft an experience letter stating that he did not fulfill his promise and did not provide notice? Also, please send me a format if you have one.

Dear Usha, Yes, you can mentioned as the employee had not served the notice period and specified term of contract but only in case if you have written confirmation from the employee.

Checking Employment Clauses and Notice Periods

Is there any written note of promise or any clause that speaks of working for two years or serving a notice period of two months? You are advised to check the clause in the appointment letter of the concerned staff. If the staff has already submitted their resignation, immediately send a letter to serve the notice period; otherwise, their salary and all receivables will be kept on hold for non-compliance. Do not issue any service letter or relieving letter. You can send them an advocate notice for the demand of the training amount.

Was this promise verbal or part of his contract/job offer? What was the nature of the training provided? Can the cost be quantified as incurred for special training, etc.? What was the specified notice period for exiting in the job offer/appointment order?

Before drafting an experience letter including these details, first review the paperwork and terms included in the offer that he has not complied with. One must write only when sure about the legality of the words and circumstances. Provide clarifications to these queries for better suggestions.

In the appointment letter, it clearly states that he will work a minimum of 2 years in our company. We don't believe in bonding an employee, so we didn't get into any such agreement. His notice period is 30 days, and he is asking us to relieve him within 10 days.
