Dear All,
A small query , my doubt is it is necessary to have workmen compensation policy to the organisation covered under ESIC , if so please suggest what type policy we have go with , any model copy available any of the team member .

If you have employees with Rs 15000+ salary then you have to obtain employee compensation policy for them.

Çompensation policy is not mandatory. If you have employees not covered under ESI and who are within the definition of the employee under the EC Act, it is better to cover them under an EC policy against your liabilities under EC Act.

Dear SVRamana,
If there is ESIC there is no need of workmen compensation however if you have employees with gross salary more than 21000/- you can cover them under WC but, along with WC you have to cover them with mediclaim also because WC only covers loss of pay. and ESIC covers both loss of pay as well as medical expenses.

ESI Act is applicable where ESIC can provide medical benefits. Where ESI Act is not applicable or where employees are out of coverage because of higher salary, employer is responsible for the compensation to an injured employee. Employer will not know as to when will be the accident and of what severity. Hence he will not know how much compensation will have to be paid. Further in case of death or permanent total disability the of employee the amount of compensation is to be paid through Court. It is, therefore, wise to take out a policy which is commonly known as WC or now EC Policy. This policy is a standard policy available with any Insurance Company. But this policy covers only injuries arising out of and in the course of employment. If employer wants to cover employees 24X7 then a general policy is taken. This policy covers all employees all the time for any injury anywhere.

From 2010 employer has a liability to reimburse the medical expense to the injured employee in addition to the compensation. Take policy that covers the medical reimbursement also.
