Sir, kindly indicate whether the unit/establishment in question, for which you have raised the issue, is a factory engaged in manufacturing activities or if it is an establishment such as a shop, hotel, restaurant, etc. In other words, what specific activities are being carried out in the said unit within your establishment?

ESI officials will look into the contract employees (though they are on other company rolls) like housekeeping staff, security, etc. If the total count crosses 20, then ESI becomes mandatory. Another point to note is that if the employee count is more than 20, but even if one person is below 21,000, then registration and payment of ESI become necessary.

Hi, Mr. Manoj,

ESIC is mandatory if the salary is below or equal to 21,000 and if your company's employee count is 19 or more. Also, please refer to the link for more information: https://www.stacowiki.in/en/acts/st-...rance-act1948/
