Hi all, I submitted my resignation on January 12, 2017, with a notice period of 60 days. However, upon sending the email, I did not receive any response, and in informal discussions, I was repeatedly told that my resignation was not accepted and that I should retract it. Eventually, on March 2, 2017, I formally requested to revoke my resignation. Following my initial resignation, I received an email on March 12, 2017, stating that my revocation was not accepted as a backfill had already been hired, and there was no current need.

After requesting confirmation of my resignation acceptance and my final working day, I did not receive any response. Subsequently, I reached out from my personal email seeking an explanation, leading to a meeting with the AVP HR, who requested time to reply. Later, my reporting manager informed me that the following day would be my last working day, and I was expected to leave the organization.

Legal Grounds for Filing a Complaint

Based on my understanding, it is customary for an employer to acknowledge the communicated last working day. Can anyone confirm if there are legal grounds for me to file a complaint regarding this situation?

Hello, my name is Sandeep Srivastava. I was working with Convergys Mumbai since May 2016. However, I didn't report to the office on January 5, 2017, after which my immediate supervisor raised a NCNS (No Call, No Show) against me. On the same day, he texted me to come to the office and resign. So, I decided to send my resignation, and subsequently, I resigned. Following this, I received the Resignation Acceptance Letter from the company.

I am trying to follow up with the HR team to provide me with the Relieving Letter and also the notice period salary (which is for two months in my case) as I was asked to resign. However, the HR team is ignoring this fact and stating that I should have served the notice period. As I didn't, I am required to pay the company the notice period amount before my full and final settlement and Relieving Letter can be processed.

I have tried to explain to them that I didn't resign but was asked to resign. I have also sent them a screenshot of the text message in which my supervisor asked me to come to the office and resign. However, the HR personnel seem to be disregarding my explanation and are insisting on the payment of the notice period amount.

At the time of resignation, I was a confirmed employee of Convergys India.
