I am a PhD student at IISER. I am eligible under MHRD, which states maternity leave as per the Government of India rules. Is a PhD student eligible for maternity leave benefits? If yes, what are the regulations for the same? Thank you.

Women employees become eligible for maternity leave under the provisions of the Maternity Benefit Act, 1961, or the ESI Act, 1948. Since you are a student and not an employee of the institute, the provisions of both acts are not applicable to you.

Thank you, Sir. Does that mean PhD students are not eligible for maternity leave at all? CSIR and UGC provide maternity leave to PhD students. I was expecting that when MHRD states that maternity leave should be available for female candidates as per Government of India instructions, they would have some guidelines similar to CSIR and UGC.
