i am 8 + months pregnant and a confirmed employee of an insurance co. now company is asking for my resignation when few days are left for my maternity leaves. kindly suggest what can be done.

Hi,
Congrats for being a mom / new mom !!!
it is highly offensive to ask for resignation from you if you served atleast 9 months with the company.
tell them clearly that you have rights to get maternity benefits and ask them to provide the same.
please visit your labour welfare officer / esi officer once if needed.
you are entitled for 84 days basic pay along with delivery cash benefit of 1000.
get back to office after delivery atleast for couple of days then you can resign the job if you want.

Since under section 12 of the Maternity Benefit Act it shall be unlawful for an employer to discharge or dismiss a woman during the Maternity period, send a letter to Registrar of High Courtt to place it before HC and to treat it as writ petition during your maternity period and quash the illegal discharge.

RELAX, no employer can force you to resign, certainly not because of the pregnancy situation. As rightly mentioned above by our fraternity members, you have the right and the employer has to grant you leave as per the act. You may extend the days (after the delivery) by using your earned leave (PL) (if you have it with you), but be careful to file/apply for the leave on time so that you do not give any opportunity to your employer to label your absence as a case of indiscipline.
There are ample legislations under which you can raise a complaint. Just be careful that you are punctual for all the days that you put in at work and preserve your official documents (since it could be required in support of your continuous employment) like appointment order, increment letters, salary slips, annual pf statements (form 23), etc.
