Dear All,
I have resigned from a corporate company with 1 month notice period.
After completion of 1 month notice period i submitted all document to local HR.
I wanted to know as per company act or policy how much time it should take to final settlement.
Our HR say it take minimum 45 day after last working.
Please suggest me what to do???
My two month salary and other benefits as per appointment letter are due.
Thanks in advance.

Dear Saket,
Your HR have given you the right information . 45 days is a standard maintained by every company .
Your salaries would be released after deducting dues, if any.
In case you need money and cannot wait for that long, at the most you may request them. They might consider on the humanities ground.

It depends on what law applies to you.
Under both factories act, wages have to be paid within 2 days from last working day.
Other dues can be given within 30 days
Most shop and establishment acts provide similar rules.
Clearing dues after 45 day is wrong in law.
However, I makes little sense to try and take legal action on this point. The case won't even come up for hearing and you will spoil your relationship with the employer which will result in problems in reference check

Hello Members, If a company takes more than 6 months or more than can employee take legal action. Also the employee has not done anything wrong all handover is clear. Regards, Jadughar
