Hi All, I joined a newly set-up company located in New Delhi, 3 months ago. The employers don't provide anyone with salary slips, a joining letter, or other basic facilities. I have seen my colleagues working nonstop for 40 hours without any monetary compensation or time off, and I am also expected to do the same. Additionally, female employees are forced to work late nights without any security or transportation provided. When I raised my concerns about security and the extended working hours to my employers, they told me to resign.

After working on Saturdays, Sundays, and late nights, today the concerned person said, "I think you have different priorities and you are not able to meet the company's expectations. Therefore, you can discontinue your services immediately."

If the company force you to leave without serving the notice period they need to pay you the gratuity of two months i.e. 2 months salary for bread and butter.

If the company fails to provide salary slips, security to women employees, or makes them work for more than 8 or 9 hours a day, join hands with your colleagues and lodge a complaint with the Deputy Labour Commissioner in New Delhi. Should you find that the company has failed to contribute to PF and Gratuity, file another complaint with the PF Office against the company. Once you receive acknowledgment of the complaints, report the same to the Ministry of Corporate Affairs.
By following these steps correctly, you will enjoy rightful monetary benefits. Additionally, the company will be penalized with fines imposed by these authorities.

Since no notice period was required by either you or the employer, it is considered a quit. Having put in less than 5 years of service, you do not qualify for gratuity. As regards your pay, please visit the office of the Assistant/Dy. Labour Commissioner and find out who is the authority under the Payment of Wages Act. File an application for your unpaid salary. Side by side, you may also advise other unpaid employees to follow suit.
The salary shall be recovered from your employer as revenue arrears, and the same shall be paid to you.
