For considering Earned Leave Casual/Sick Leaves are counted as worked days as per my view, please wait for other seniors to give their views too.

Working Days are defined as total number of days (365 / 366) during financial year less 1. All Sundays / Weekly Off; 2. All National Holidays; 3. All other declared holidays of the establishment; 4. All Absents of the particular employees; 5. All types of Leave - Casual / Sick / Privilege.
In light of above facts, All Earned Leave Casual / Sick / Privilege Leaves can not be counted as worked days for calculating earned leave for that financial year which is one per 12 days for commercial establishments registered under shops and establishment act and one per 20 days for factories establishment registered under factories act.

Subject - Earned Leave
As per the provisions of Factories Act 1948
Eligibility for Earn Leave-240 days is specified. This 240 days means =Days actually worked in the previous year+Lay off if any+Earn Leave Enjoyed in the previous year+Maternity leave sanctioned as per MB Act. Considering all this if an employee has completed 240 days then he will be eligible for Earn Leave for next year. But the Earn Leave will be calculated only on Days actually worked not on lay off/EL enjoyed/maternity leave sanctioned. Hence Casual Leave/Sick Leave or any other paid leave can't be considered for calculation of EL under Factories Act 1948
