I have been working in a Pvt Ltd Company for more than 7 years. I have a query related to PF deduction. I obtained my company's PF information from the PF site and discovered that they are not deducting my PF; only a few employees' PF is being deducted by our employer. The appointment letter also states that they will deduct PF. Kindly guide me on what I can do (practically and legally) as my company is not deducting PF from my salary but deducting from other employees only.

Please contact your HR Department regarding your query. If they are not providing a proper reply, you can approach the PF Enforcement Officer in your area, who is readily available in Baroda. He will conduct an inspection at your company to ensure that all employees' PF contributions are being deducted correctly.

As explained by Mr. Bhasker, do not overthink and assume; it is better to first consult with your HR Department. Only after that, come to a conclusion and decide on further steps. There may be a possibility that you are working for the same company but on a third-party payroll, and the PF from your salary is submitted by that party. So, do not indulge in "may be" or "may not be" scenarios, but consult your HR to get rid of any confusions.

Understanding the PF Deduction Issue

First, let us understand the issue. Is it that the PF is not being deducted, or is it that it is deducted but not paid to the PF department? (Check your wage slip). If it is not being deducted, why did it take you 7 years to realize? Also, are you an exempt employee under the act? You need to check all this before going to the PF office with a complaint.

Please do not conclude and jump into actions. First, check your appointment order. If you are in a professional contract, then they should have deducted TDS and paid your salary. If PF is not deducted, contact your HR Department and gather information. It is surprising that you are raising these questions after 7 years. It might be that you have been misled by incorrect information or guidance. Be cautious before pointing fingers at your company, which has taken care of you for all these seven years.

I second Mr. Banerjee. First of all, please confirm back to the forum whether you are an exempt employee. Please check the basic amount of your salary. If it is below Rs. 6500/- or more than Rs. 6500/-, if your basic is more than Rs. 6500/- per month, there are chances that you are covered under exempt employee. If the basic is below Rs. 6500/-, then check the employee strength on roll to give you an appropriate answer to your query.
