If there is a tax deduction at source, it means that if the company has deducted any tax from your salary, the company is bound to issue Form 16. However, if there is no deduction at all, the company is not bound to issue Form 16.

If any employer is not providing you with Form 16 A in the case of TDS deduction in salary, you can register a complaint against the employer with the help of the Labour Court. The Labour Court will take action against the problem.
