Dear all ,
Thi is a case of mine friend, he shift his job due to better oppurtinity his resignation was accepted by the organization then after completion of notice period he was told that the clearance will be done on the monthly salary Date. but it was't.then after till now the company is just saying that they will pay him the amout but dont know when since last two month he has not paid so i suggested him to send a legal notice to the company through the lawyer but is it the correct way ?

Dear Parag,
In most of the companies F&F process takes ranging from 15 days to 30 days max. It also depends upon the financial credibility of the company, whether they are able to pay the salary or not. The legal way should be taken only in such a case when you loose hope that your pending payment is not going to be paid by the company. Firstly talk to the company for payment if you loose all hope then resort to legal way. I would recommend to wait for another 10 - 15 days with clear verbal communication to company that if your dues shall not be cleared within those days you will take legal action to recover the amount.

Hi Parag,
If your friend has not got the FnF settlement cheque, first tell him to kindly go the office and check whether all his documentation and other clearance stuff is complete or not, because at times if the form is incomplete or any one of the approval is not their then it may happen that they must kept it on hold and further communication has been sent through letter to your permanent residential address. In few of the cases the letter do not get delivered.
If all the things are in place, then you can talk to your HR or HR manager for the same stating its been delayed over 2 months..kindly release the payment in a 3 days time..if still the prblm persist only in that case u have to take strict step.

Please clarify me,that if any company is not in a position to salary continuously 3 months,in that case is it necessary give resignation to present employer before joining other one for earning bread for the family.
If there is any law pl.let me know.

I worked for 30 yrs in PSUs having internal audit/statutory audit and AG\'s audit.We never delayed the payment of dues after termination of service for more than 5 days.But private sector can be faster.

No Verbal communications, send written communications with regards to F&F if no responses then you can approach local labor office
