Hi,

I worked in this MNC for 11 months and got relieved on 15, August(after giving proper notice and serving full notice period as mentioned by them and handed over all the company asset's in a proper way, in nut shell its a smooth release).

I am following my HR coordinator for my experience letter but he is not even responding, no reply to emails, no proper response over phone. The disappointing part is that in my last mail to him I kept my HR director in loop, even then there is no reply. What should I do now???

Further, I would like to explain the series of events to explain my situation better.

i) Actual notice period is 2 months but I was told by my reporting boss its enough to serve 45 days, so I did the same. There is no request from my end for an early release.Also no word from HR asking about early release. Just a mail from my HR mentioning my last day of work.

ii) About a month before got a mail from HR with details on my FnF settlement. In which they had deducted a substantial amount under the clause that I did not serve 16 days of notice.

iii) I wrote a reply explaining that it was their decision to relieve me early and I never asked for an early release and in fact I was ready to serve my complete notice period.

iv) As a reply they asked for some time to check on this.

v) Also I am following for my experience letter but no word on it right from day one of my release.

vi) Now that its been almost a month since I got that last reply asking for some time, after that no word from their end.

vii) I am in desperate need of experience letter, what should I do now??? Also would it take a months time to check on things.

Seniors pls help me here.

Hello Aravindh, Its really nice you explained it in detailed manner. I appreciate that you handled this situation in a very matured way. As i had gone through the complete issue. I found out few points which are missing somewhere.

1. you served 45 days notice period. They have written condition in your offer of 2 months. so in front of this do you have any written mail or application signed or sent by your boss that you can relieve after 45 days??? please let me know...

2. HR is right with his point because he can show you the clause of his company in which mentioned that if employee will serve less then 2 months then salary will be deducted according to that.

3. You don't have any written document regarding your boss acceptance on 45 days notice period instead of

2 months. if you have then send them in mail to show your proof.

Now point is they are not coming back to you one is because you are not ready to adjust with deduction and they will take time because need is yours. you followup should be there please and if you don't have any documentation of 45 days notice period acceptance then speak to your boss to settle them on his level and send some authorized mail or document signed by him to HR on behalf of you, or meet him personally in office and discuss this issue. Once HR will get this kind of any document then he can't deduct your salary. also send them email regarding your experience letter and mention some issue of next joining which is insecure now just because of this document and if you will not submit it on time then you'll loose the opportunity. so that in future If they go legally then you can also show this proof. But you should keep some strong proof of your relieving acceptance. It is not that much complicated. just they are trying to adjust the amount and HR will be appreciated for this by company. so speak to HR nicely and your strong point is your ex-boss. speak to him regarding this.

At the onset thanks for the reply.
Talking about written communication from my ex-boss, NO I do not have any such document. All I have is a mail from HR mentioning my last day of work. But it simply says that "My resignation is accepted and my last date of work will be so n so".
Though I walked out in a smooth way, I am afraid he may decline my request. And I am not sure whether he will help me out of this.
So if its a not so favorable reply from my ex-boss, then what other options do I have?
Also when it comes to communicating to HR, I am fed up trying his number and I had dropped number of mails but no reply from him. Should I go ahead and call company's HR director or should I wait for some more time. I feel like I should wait till I get my experience letter. What would you suggest?

If he replied on the same mail which you had sent then it can be a proof of your relieving with your Sr. permission. But only if you had mentioned in your mail that notice period is settled with the Sr. boss permission or acceptance. otherwise its just an acceptance of your letter in which you had mentioned date according to your suitability.

Don't give up so soon. just try to reach your Ex-boss and speak to him. if he had already accepted and settled your notice period then hopefully he will be there for you.

HR don't move without his management support. If he is not responding then its sure he is following the orders. wait for a while just send him again an email to give the reminder of experience letter. But it'll not be possible without F&F, so the only option you have to meet your ex-boss or speak to him. Request him to consider this issue on priority basis as its urgent for your carrier point. follow up with him for next 10-15 days and in the mean while also try to reach HR person or send him mails with proper gap period simultaneously.

If nothing works then send the thread mail to HR director which you'll do with HR person and Ex-boss and request him to consider this issue on his level. But your communication should be very polite and humble. Because you don't have any documentation proof. In HR directory email you can mention that you'll follow up with him after 3-4 days. and if possible give me the suitable time to meet with you personally. Try to be very humble and in requested manner.

I hope something will work and you'll get all your documents as per your requirement.

Now getting back to the issue.

After repeated mails and phone calls I got my payment and that too in full (no deductions :) ).

But the problem is when I ask for my EXPERIENCE LETTER (after so many phone calls and mails) my ex-HR replied that they do not have the policy of giving an experience letter and the mail which I got as a reply to my resignation mail will suffice. I doubt whether this letter will do any good.

For your reference I have pasted the contents of the letter which I got as a reply to my resignation mail.

"This is to inform you that your resignation dated XXXXX is accepted. You are being relieved on the closing hours of XXXXXX.

In order to make the exit a smooth process we request you to click on the link below.If you have any difficulty in getting the link, copy the link and paste it on the internet explorer. Once you are on the page you will see a screen as shown below. Click on the "exit interview" button, this will get the process initiated. Please contact XXXXXXX if you have any difficulty. Your accounts will be settled in accordance with the rules and regulations of the company after submitting the No Objection Certificate ( NOC) with no dues to the company ( Assets, cash advances, laptop etc).

Request you to handover the company property. Kindly call me for any further details.We wish you all the very best in your future endeavors."

Also earlier when I asked for experience letter, they told me that I will get it once when my settlement issue is solved. Now they say that they don't have the policy.

I am confused and as far as I know every company (atleast MNCs) are obliged to give its employees their proper relieving paper not just a mail with the above content.

Should I contact HR director (again) or do I have any other option.

Pls help me here.
