One of our employees is absconding. He used to work on the project site (he is not a laborer/worker). When we contacted his family, we learned that he leaves home, saying he is going to the office, but he doesn't report to the office or the site.

Action Required: Drafting a Warning Letter

Please let me know what needs to be done. I am preparing a warning letter for him. Kindly help with a draft for the same. Also, let me know if sending three warning letters is mandatory.

In our organization, an employee has absconded with the company's laptop. We have sent him a warning email and a warning letter to his residential address. However, he did not accept those. Please suggest what should be the next step?

Absconding as Misconduct

Absconding by an employee is treated as misconduct, and a proper inquiry must be conducted, with punishment imposed as per the judgment in M/s Economic Transport v Dharmendra, decided by the Delhi High Court in 2014.

Legal Action for Property Recovery

Lodge an FIR to recover the laptop because you had entrusted the property to him, and failure to return it is an offense under Section 406 of the IPC.
