Who is responsible for manpower compliances in terms of EPF & Misc Provisions Act , Inter State Migrant workers Act, Bonus Act ,ESIC Act, BOCW Act ; MPT Act, MLWF Act etc... Principal Employer or Contractor?
From India, Mumbai
It is the primary responsibility of the Contractor to adhere to all statutory and compliance check points for the workmen he deploys.
In case the Contractor fails to do so,it becomes the responsibility of the Principal employer to comply with all such points.

Hi, Its absolutely correct. It is the responsibility of contractor if hired, otherwise sole responsibility of principal employer. Regards Sandhya

Dear All,
I am a Civil Contractor based in Pune.
I have been working with a reputed Construction Company of Mumbai for past one year.
Recently the Principal Employer has made it mandatory for all the Contractors to get registered under EPF act.
However my proprietary firm employes less than 20 employees directly or indirectly. On any given day the no of workmen of the site are less than 20 including the supervisory staff. We fail to understand that when the law does not compel us to register under EPF act, can the Principal Employer compel us to do so???
Please advice.
Regards,
ARP
