The ESI Maternity leave will be granted to the employee by the concerned ESI Dispensary/Hospital, where the consulting doctor will clearly note on the sickness sheet that she is under medical treatment and needs rest. The employee will submit the same sheet to the concerned HR. The period of absence will be written on it.

Dear Peers,

If a female employee with 5 years of service was previously covered under ESI and now earns more than 15K per month, and she wishes to take Maternity Leave, who is liable to pay for the 84 days of ML? Is she eligible or not?

Post the act says...

If the female employee, having been an Insured Person (IP), is now outside the purview of the Employees' State Insurance (ESI), she will be eligible for Maternity Benefit from the employer if she is not eligible for it under ESI rules.
