Greetings for the day!

Please guide me on OT calculation according to the Shop and Establishment Act in Goa.

1) I want to know if the gross salary is taken into consideration, or basic+DA for OT calculation.

2) According to the Shop & Establishment Act in Goa, the maximum number of hours an employee can work without OT is 8 hours per day and 48 hours per week. If in an organization the normal working hours are 9 hours per day, which include a 1-hour break, and normal working days are 6 days a week, I want to know what is the extended time, including break time, for which an employee can work without overtime.

3) According to the Goa Shop & Establishment Act, the number of hours that can be extended, including OT hours, should not be more than 12 hours per day and 6 hours per week. But what should be done if it gets extended?

Dear Hardik,

Thank you for the attachment. I referred to the Goa Shops and Establishment Act book and devised an OT policy for our company. However, I wanted to know if we can exceed the allowed OT hours. For example, if the permissible OT hours are 6 hours a week, what if employees' OT exceeds more than that? Of course, we are paying them for all OT hours.
