I would like to ask a favor from you in sharing some of your knowledge with us. As per labor law, there should be 26 working days. In months with 31 days, if there are 4 Sundays, the working days become 27. Can we show 27 days in the Salary/Wages calculation?
Similarly, in a month with 30 days, if there are 5 Sundays, the total working days become 25. Is it acceptable to show 25 days in this scenario?

yes, you can show the actual No. of working days in a particular month. Feb may be 24 days. pon

The system of 26 days' wages for all months can also be followed for computing wages. In this case, irrespective of the number of physical working days in the month, wages are paid for 26 days, including February. This system is followed when the annual leave credited to an employee is based on a consolidated days basis. Otherwise, the actual working days are followed.

I have a logic regarding this issue: 365/12 = 30.46 - 4 (weekly Off) = 26 working days. In our company, we are using this formula for calculating the outsourced employees' payment, i.e., 260/26 = 10 * 10000 (rate) = 100000/-

the labor laws shows that number of working days in a week should be 6 days out of 7 days. If we show like that there is no problem about 26 or 27 or 28 days in as month.

Factories Act is very clear on this. Please go through Chapter VI, Working Hours, and weekly holidays. It does not state that there should be 26 working days. In a nutshell, we need to give one weekly day off each week.
