Hi all,

Please help me to clear the below. I have been under the ESI scheme for the last 2 years. I took ESI maternity leave starting from 26th of February and just now came to know that the company increased my salary effective from January 2011, which exceeds the 15000 limit of ESI. Am I still eligible for receiving the ESI benefit?

Please help.

Hi Manisha,

No doubt, until March 11, you are undercover for the same. As per my view, this will continue for up to 90 days from February 26th. In case you are exempted from April 1st, you can claim the remaining leave from the company.

You will get all Maternity Benefits. if you will not come in ESIC range then Maternity Benefit Act will apply.

Dear Manisha,

Greetings for the day.

As you mentioned that your wages increased to Rs. 15,000 from 01/2011, it appears that you are still within the ESIC ceiling. To be eligible for exemption, your salary should be above Rs. 15,000, specifically Rs. 15,050 or Rs. 15,100. Additionally, the ESIC deduction applies to you up to the contribution period that ended on 31-03-2011.

As per my knowledge, although your salary has been increased beyond the ESIC limit in January, the company has to deduct and pay the contribution up to March 31, 2011. Furthermore, you will be covered for the next six months.

hi manish, finally u r under cover of ESI because your contribution period is up to March 11 and beneficiary period will be june 11, u can ask your H.R regarding the same good luck Rajvir Singh

His contribution period will be March 2011 and beneficiary period will be up to September 2011, i.e. for next six months. hope this matter is clear now.

Hi Grettapl,

Contribution period is:
(a) 1st April to 30th September (first half)
(b) 1st October till 31st March.

The corresponding benefit period is:
(a) following 1st July to 31st December
(b) following 1st January to 30th June.

Thus, the 'Benefit period' starts three months after the 'contribution period' is over.
