Hi Ganesh,

Yes. It is mandatory that you register your establishment under the shops and establishments act. All establishments other than factories need to be registered under this act within 30 days from the date of commencement of business. If you do not do this, in case of inspection, you might have to pay penalties.

Here are the formalities:

1. For registration the employer has to apply to the Sr. Inspector (Shops & Establishment) of his respective Municipal Corporation of Greater Mumbai Wards in the prescribed form ‘A’ togetherwith requisite fees .

2. Form ‘A’ must be accompanied by the authentic documentary proof as regards rightful and exclusive possession/ occupation of premises and also the proof of business conducting.

Such documentary proof shall be in the nature of rent receipt of premises, consent letter from principal tenant, valid leave agreement, electric bill, ration card, property tax bill, Allotment/ occupation certificate of premises, business transaction proof, partnership deed, memorandum of articles, incorporation certificate etc. as deemed to be satisfactory to the Sr. Inspector (Shops & Establishments) Wards.

Registration Certificate is granted for one callender or three callender years depending on the option exercised by the employer.

Just want to know,In case the establishment without major power consumption has been started with 15 employees.so it does not need to get the registration under this act.after some time the employee strenght exceeds the no of 20.
then when to get registration?
What about if the emp are outsourced and not on co pay roll?

Hi Archana,
You are right. But the day when the employee strength reaches 20, you need to get the registration done.
For employees who are outsourced, it is the responsibility of the principal employer to get this done. Hope this clarifies. Thanks.

Is shop and establishment act applicable when there are no employees.
what should be the number of employees for applicability of the provisions of the act.
I want to launch a web portal. For managing the portal I would be outsourcing the work to other agencies who would be working either at their own place or may work at my place for brief period. I may opt to have one or two employees. Please guide

Is the threshold of 20 employees per location of an organisation ? E.g. I have more than 20 employees at one location and 5-6 employees at another. Do I have to get both the locations registered.
