My Dear Friends,

All employees whose salary was above and equal to Rs. 10,000 but below and equal to Rs. 15,000.00 have again come under ESI from May 2010. In our company, those who are not under ESI will get 6 days of sick leave in a calendar year. As per our company policy, on the 1st of March, May, July, September, November, and January, 1 sick leave day is credited in the leave register for the employees who are not under ESI. Some employees who were previously not under ESI were credited sick leave for January and February on 1st March 2010, and for March and April on 1st May 2010. They have not yet availed these sick leaves. From the month of May, they have again come under ESI because their salary is below Rs. 15,000.00.

Now, my question is whether they are eligible to avail those unutilized sick leaves.

Dear Ashok,

Yes, they are entitled to those leaves. Since the applicability starts from May 2010 and before that, the company provided the facility of SL.

Regarding your company policy, will SL lapse if not availed? Please refer to the standing order terms for clarification, and then you can decide.
