Can anyone give me details that after what exact working hours is the overtime applicable and also from what level does the overtime payments starts and is applicable to what grade or level.
Please help.

Dear Bilal,
Over time in a week should not be more than 12 hours, should not more than 50 hours in quarter, should not be more than 4 hours in day as per factory act 1948. Also, it is paid at double rate and ESI to be deducted on the ot amount. As for as grade or level concern most of the industry pay overtime in worken cadre drawing upto Rs.15,000/- per month gross salary. For others, you can design incentive plans drawing more than 15,000/-
If requirement of ot is more than it is better to design incentive plan for all.

Over time should be paid as per the Factory Acts 1948. All statutory deduction to be deducted,
As special provision, you make take special permission for more that 50 hrs up to 75 hrs in quarter from appropriate govt authority.

Very interesting. Not being aware of this, there are many companies that are making staff do overtime and paying almost half the staff salary as overtime!!!! Thanks babanaresh and nagarpankaj07, for the information. Hi Babanaresh,
what do you mean by 'OT to be paid at double rate.?
In our concern, the additional hours spent are paid at hourly basis with gross salary per hour. If monthly gross salary is G, then the calculation goes as below
G x 12 / 365 / 8
(8 is working hours per day)
Is this calculation right...?

Hi Shabana, How ru overtime calculation is G x 2 / 26 / 8 x overtime hrs. then ESI deduction on overtime amount is compulsary. thanks, i hopr ur query will resolver. Chander HR-Exec.

hi all,
the corrected formula is:
Monthly Gross/26/8 * OT hrs * 2 for OT calculations. as per factory Act
OT is mandatary for employees drawing upto Rs. 10,000/- as per miniumum wages act

Dear Manish,
I do not think there is any provision or rule under the Minimum Wages Act, 1948 which says that OT is mandatary for employees drawing upto Rs. 10,000/-. No wage ceiling is there in this Act.

Dear shabana,
Suppose an employee has done over time for 10 hrs in the month of july and his salary is 15,000/-per month,
then ot amount and esi would be as follows :
Ot amount 15000/31/8*10*2=1209.67,means Rs.1210/-(to be divided by no.of days of that month)
Esi deduction on ot amont 1210*1.75%=21.17(means Rs.22/- to be deducted from employee)
Employer share of Esi 1210*4.75%=57.47(means Rs.58/ to be paid by emplyer)
Total amout payable to an employee would be = 1130 (1210-80)
Total ESI amount for deposit under challan would be = Rs.80/-
