Most companies, when designing policies on employee leave, include an important statement: "Employee leave is a privilege and not an entitlement." Any employee must proceed on leave after obtaining approval from the competent authorities. If, due to contingencies, prior approval could not be obtained, the employee must submit the application for regularization purposes whenever he/she reports for duty. However, even then, whether to sanction leave or not is at the discretion of the HOD or any other approving authority.
Now, in your case, how has the employee developed the "habit of proceeding on unauthorized leave"?
Whether during the notice period or otherwise, if the absence is unauthorized, you may initiate disciplinary action for the misconduct. To change this wrong habit, it is important to take disciplinary actions.
