I have a query regarding the labour License.
In XYZ Company, a contractor is having the license for deploying 100 contract labour per day (In the license it is mentioned as “Number of workmen employed as contract labour in the establishment shall not, on any day exceed 100”) but in his muster roll there are 120 contract labour names. Though he is having 120 names in the muster roll the daily deployment of contract labour is only limited to 100.
My query is that the contractor has to get license for all 120 labours or the current license is enough?

if he is sending only 100 at a time in to orgn then no need for licence.since hew may be sending labours on rotation basis for which he has keep 120 labours. if in any case it crosses 100 then he has to get licence. else no need.
I want to know if the contractor is having less than 10 /or 20 Nos of employees then whether it is necessary to have PF Licence for contractor or in case can contractor distribute the wages without deducting the PF12%.
whether can appoint contractor without registered and having the strength less than 20 workers and what is the liablity of principal employer in that case when he didnot deducted and deposit the pf 12%.
My friends those are suggesting to get amendment in licence for 120 employees, is wrong. If your contractor is deploying maximum of 100 employees at a point of time then there is no need to get it amended.

Contractor and Principal Employer will have to amend the Licence as well as Registration Certificate, if the strength crosses the limit of the strength shown in the R.C. & Licence on any day of preceding 12 months.
