Please refer to Section 4 of the Gratuity Act. Gratuity of an individual can be forfeited if services are terminated due to riotous or disorderly conduct, any act of violence or offense involving moral turpitude, or willful omission, negligence causing damage, or destruction of property belonging to the employer.

Thank you, sir, for reminding me. However, what about a pregnant female employee who has worked for 2 years in a firm but has absconded from duty without notification and does not want to continue working? In such circumstances, is gratuity payable?

When an employee is not eligible for the payment of gratuity, then that employee will not be given a gratuity payment.

I am leaving my job after completing 5 years and 1 month with an offer of a 5-day notice period and 26 days of Paid Leave deduction from my account due to an urgent joining at another company with a better deal. I want to know if I will receive my gratuity at the time of Full & Final Settlement in the scenario where my previous company does not accept my resignation and labels me as Absconding.
