Dear seniors,
I have worked with a private firm which had outsorced the employment to a consultancy.So we are off roll employees working for a private firm.The private firm has lost the business to other firm so we were asked to resign.We have worked for 15 days in the month of December.We were told that we will be paid the salary for the worked days.We have finished all the formalities for the full and final settelment.But when we contacted the consultancy they say that they have a problem with the payment and still they have not recieved any confirmation from the private frim regarding the full and final settelment.Ther is problem between the consultancy and the firm, so why to stop payment for employees.We are unabel to get the PF amount also.So i am planning to report inthe labour commision office.So please guide me the process.

Hi!
OK, you have worked only 9 month and 2 month respectively,
there are two question in my mind.
1. have you received confirmation letter?
2. and if you received appointment letter, what is the condition of employment?
please give me the sufficient information.

First of all thanks for your prompt reply.Here i am worked as a contract employee and there is no question of confirmation.But as a right i should be paid my 15 days salary for which i have worked and my PF.There is a issue between the firm and consultancy in some money matters.Why should we suffer for their issue.

Correct, why will you suffer this is totally look after of your employer, and again Every employer shall be responsible for the payment to persons employed by him of all wages required to be paid. if they don't do, law say auction the fixed assets and disbursed all salary amount.

Don't panic, you should write a humble letter to your employer, mention time frame and Ask for your payment. this is necessary for maintaining records for future reference.

after receiving the letter, your employer reluctant to give your salary, again you write a reminder letter and mention some time duration for payment of your salary, if they don't give your salary within stipulated time period , than you write a request letter with mentioning your reference latter which you have given to your employer to Asst. Labour commissioner (C) or Asst. Labour commissioner (State).

For the purpose of PF,if you have PF account number and you don't want to contribute further in PF, write a letter to your employer with giving reference to your PF account and mention your all details including your salary slip and ask for withdrawal PF as the employment has been terminated.

If you dont have PF number, again write a letter mention your salary slip details of each month and payment deduction amount and ask for Account number, if they don't provide, write a request letter to E.P.F commissioner with reference letter which has given to your employer.

you will definitely get good result.
