The application of Contract Labour (R and A) Act, 1970 applies to every establishment in which twenty or more workmen are employed or were employed on any day of the preceding twelve months as contract labour.
The situation:
01. The Establishment has outsourced some of the work on job contract and the total number of workers engaged by its job contractors are more than 20. The organisation has therefore registered with the Regional Labour Commissioner as Principal Employer.
02 Each of the job contractors are however engaging less than 20 persons, therefore the Regional Provident Fund Commissioners Office is not Registering these Job Contractors for depositing the PF contribution of their workers?
03. As per the EPF & misc prov. Act 1952, the coverage is extended to every establishment employing twenty or more persons.
There is a dicotomy in the situation how do we go about it? What are the implication?

Every month after salary day contractors are to submmiting their bills to you, in that case you should clearly observe the PF deduction part and once bill checking part will over from your side make a note to Account section on bill sheet like only prepare a check on Labour charges, service charge and service tax but dont consider PF amount this amount will keep with company and you can put in your company account and deposit to pf office.

Dear Sanyalanjan,
If PF Account is not thier of your Contractor, You may collect all the employee details from contractor, & with consultation of the PF Office you may apply for contractor Registration on behalf of your PF Registration. & then deduct the PF of your Contractor & Deposite to PF Office & the same you may debit to concerned Contractor.

Hi Sanyalanjan,
where r u located ? as per as my knowledge there is new amendment regards the act where pf will be applicable for the establishment where more than 10 employees are working. pl. find out.

dear all
in my company i have registred with contract labour but due to non availabality of more orders i have not taken the contrcat workers. do i have to cancel my registration. do i have inform to labour office.
what is procedure ?

I am working in consturction company 600 labour are working under contract labour act. they are not maintaining any PF & ESI above said labour he has taken a insurance policy under Workmen compensation act.
this is insurance only sufficient.
Please guide me.

Hi All,
The EPFO has issued a notification to the principal employers to deduct PF on the Labour charges paid to the contractors. I hope this notifications is issued sometime in 2005.
If someone has the notification, pls pass this to the group. Will also try to get this notification.

Dear
Registration under the Contract Labour Regulation & Abolition Act is totally different than registeration under PF Act. For registration under the Contract Labour Act, the employer send the information about the name addressnature of job and the avg no, per day to be employed by each contractor; whereas if the contractor is employing more than20 workman on any day than he he has to get himself registered under the above Act.
RegardingPF, if you go through the registration form, there is one column Voluntary under this col, PF Authority is bound to register even if you are employing less than 20 person only formalities is that employer and the employee have to give an undertaking about voluntarily coverage.
