I am Paying epf to my employees and I taken medical insurance each employee.. I got call from esi office to pay esi to compulsory please I need to help I need to pay ESI or Medical Insurance is fine ……

1. Sir, coverge under ESI Act, 1948 is compulsory in case your establishment/factory is located in implemented area and employ 10 or more persons. In respect of such employees, who are covered under ESI Act, there is no utility, in my opinion, to get any medical insurance policy. However, in respect of such employees getting wages more than Rs.15000/- per month and not covered under said Act, you can get such employees covered under any medical insurance policy.
2, It is also important, in my opinion, to appear before ESIC authorities and comply with their instructions/Act/Rules/Regulations, in case, your unit is covered/coverable under said Act. This is important in order to avoid levy of penalties/damages/prosecution in case of default.

there cannot be a second thought when ESIC is statutory. However you can cover all your employees under mediclaim insurance as an additional benefits.

Sir, if there is any short-coming in ESI medical services including too much distance of ESI dispensary, you can make a representation to the appropriate authorities for such improvement. Statutory provisions of any law are not optional.
