A workman working for the last 10 years, while on duty fainted due to a brain haemorrhage and was taken to a nearby hospital and he was in comm. It has been over six months, but he is still in a comma. Please suggest under such circumstances:
1.0 Obligation of the employer with respect to Accident Report to the Factory Inspectorate though it was not an accident, but the person was on duty.
2.0 Liability in terms of the Employees Compensation Act. Whether his disability will be treated as 100%
3.0 Can Management terminate his services on the grounds of continuous ill health? What procedure is to be followed?
4.0 If yes, what is his gratuity liability?
5.0 Legal liability of the employer to bear the medical expenses
Kindly suggest.
