Dear All,
This is shyam, I have one doubt regarding gratuity. Last month (May-13) one employee retired from my company, actually he joined in 01.11.2010 as Manager. This employee is eligible for gratuity?. Please suggest me.

I agree with Vishnu. He is not eligible for gratuity since he did not complete the minimum qualifying period.

Dear Shyam
The Gratuity Act clearly mentions that a person is eligible for Gratuity only after completion of 5 years contonious service. Here the mode of seperation (Resign, Retire, Terminate, etc) is not a criteria for eligibility unless its a death case.
