I am seeking for your help. I am working as HR Manager in a collection agency. We have telecallers, field executives and field supervisors, I am preparing HR policy for them. I want to know that which section of Labour law will be applicable here.

We donot have labours in our organisation. While preparing HR Policy for the company, I am confused, which law I should follow. We are providing PF, Mediclaim, Insurance etc.

Dear Mamata,
Looking todays scenarios on the part of workmen as stated in Industrial Disputes Act or other related labour laws, it is very difficult and covered by the unionism, u r very lucky as ur company has no labours but employed Officer or Executive level people in employment. They are not covered or and debarred from the defination of WORKMEN.
However, prepare ur HR policy for their appointments, salary structure, bio-data, amenities, facilities and more.
Mamata pls. remember that they are covered under The payment of wages Act, Payment of Gratuity Act, Payment of Bonus Act if they are receiving salary below 10000/-and in the case of women The maternity benefit Act, Workmen/Employee's Compensation Act, ESI Act if ur's is implemented area( where ESI coverage is in force then enforcement of Maternity Benefit Act and Workmen/Employee's Compensation Act is barred automatically), Employee's P.F. & M.P. Act,1952 all these and other statewise acts might be in force.

Dear Mamata,
It is not the designation of employee that is looked by law whether the concerned employee is a workman or not but it is the nature of work which matters ( as per Industrial Disputes Act,1947. Hence, first please look into the nature of work being performed by them. Read defination of workman in ID Act.

Ya, i agree with sunil sadar, nature of work is important aspect to decide whether it is executive or clerical or labour work. The manager of small hotel should not be an officer if he is doing supplying work.
