Dear Sirs,
I work for a company registered under Shops and Establishment act.
Please let me know whether the company has to give EL compulsory under this act? If so, whats section of the act says it is compulsory?
If compulsory, what would be the penalty if a company doesn't follow?
Please also suggest what would be the ideal leave structure for a ITes/BPO company?

Dear Member,
All eligible employees are entitled to receive earned leaves as per the Shops & Establishment Act & therefore these leaves are compulsory. For further clarification plz go through your applicable State Shops Act for penal & grant of EL provisions.

Earned Leave is manadotary for every permanent employee who had completed 240 days of continous service in an establishment. Though the act differs from state to state it mandates every establsihment/factory/shops, etc to provide such number of days as EL for leisure & recupriation.

Sir,
The act doesn't say that EL is compulsory. It only talks about one leave per 20 days. It also doesn't mention about what kind of leave... CL,EL etc.
I have heard many companies still following 12 CL and 12 ML structure. Is it correct? (ITes/BPO) What does the law say specifically about the structure? Can any one refer with subsections of act!

Yes, If you are registered under act then it is compulsory to allow EL/PL And CL, if somebody work for 240 days then allow him/her 12 EL or PL and also can allow 6 SL and 7 CL
