I do not know, at what level you are terminating your employee
You may look following process
1. Does your employee fall under workmen and also does Standing Standing Orders Act applicable to your organisation? If yes, please follow the process mentioned therein
If it is not applicable to you, does your organisation have employee handbook? Is there clarity on provision mentioned therein? If yes follow that
Please look following aspects
1. Why are you terminating your employee? Do you have enough evidence including communication, memo to support the same? If yes, kindly mention all the details in the termination letter with date, acceptance of employee and also attach required supporting
2. have you given fair hearing and applied principle of natural justice before taking such decision, if not you may land in legal trouble. If yes, please mention the date of such hearing and communication
3. Please write appropriate reason for terminating employee and exercise it only in the severe case. You may find other skills relevant to employee (if the issue is performance)
