if an employer pays PF of employees which were in arrears for a year in two instalments. (due to heavy pressure from the PF officers)
but finds that the employer does not require to pay for employees who were drawing more than rs 10000. originally speaking the emplyer was cheated by the PF officers who knows that the manager who looks after the firm had no knowledge in PF.
now after paying the PF, but came to know abt the PF ceiling the employer wants to fight the case stating to reimburse the PF he has accedentaly paid.
does he has the provison to calim back. the PF officer only has the wage register where we has only filled the BASIC Wages colums which amts to 6000 for most employees but has not filled any column even the DA. but in the gross salary exceeds 11000 which was aslo paid through the Bank which has solid profs through bank statement.
please tell us if we have a good case. as the PF peoples has clearly cheated the emplyee by concealing the rule abt PF celing
