Dear all,

this must be an interesting topic, which one can face.

AN EMPLOYEE, DUE TO SOME POLITICS IN OFFICE, IS BEING ASKED FOR HIS RESIGNATION THOUGH HE IS WILLING TO SERVE THERE. HE IS JUST ASKED BY THE HEAD HR TO MOVE OUT OF THE OFFICE LEAVIN ALL HIS USABLE AS IT IS WHERE IT IS.

THE PERSON MAY HAVE A CONTRACT OF 3- 6 MONTHS IN LIEU PAYMENT THEREOF FROM EITHER SIDE.

PLACE YOUR COMMENTS ON THIS TO HELP OUT THAT GUY.

WE CAN ASSUEM THAT MOVING FOR LEGAL ACTION WILL NOT BE PROPER AS THE INDIVIDUAL CAN NOT BARE THE COST FOR THE SAME AND IT ALSO DEPENDS ON THE COMPANY STRUCTURE

THERE IS AN INTERESTING STORY FOR THIS PARTICULAR SITUATION.

The below story was discussed in IIMB and has a

Lesson to learn!!

PVNR (PV Narasimha Rao), L.K.Advani and Laloo Prasad Yadav were traveling in an auto rickshaw. They met with an accident and all three of them died.

Yama Raja was waiting for this moment at the doorstep of death. He asks PVNR and Advani to go to HEAVEN. But, for Laloo, Yama had already decided that he should be sent to HELL.

Laloo is not at all happy with this decision. He asks Yama as to why this discrimination is being made. All the three of them had served the public. Similarly all misused public positions, etc. Then why the differential treatment?

He felt that there should be a formal test or an objective evaluation before a decision is made; and should not be just assessed on opinion or pre conceived notions.

Yama agrees to this and asks all the three of them to appear for an English test.

PVNR is asked to spell "INDIA" and he does it correctly. Advani is asked to spell "ENGLAND" and he too passes. It is Laloo's turn and he is asked to

spell "CZECHOSLOVAKIA" .

Laloo protests that he doesn't know English. He says this is not fair and that he was given a tough question and thus forced to fail with false intent.

Yama then agrees to conduct a written test in Hindi (to give another chance assuming that Laloo should at least feel that Hindi would provide an equal platform for all three).

PVNR is asked to write "KUTTA BOLA BHOW BHOW". He writes it easily and passes. Advani is asked to write "BILLY BOLI MYAUN MYAUN". He too passes.

Laloo is asked to write "BANDAR BOLA GURRRRRR.... ." Tough one. He fails again.

Laloo is extremely unhappy. Having been a student of history (which the other two weren’t), he now requested for all the 3 to be subjected to a test in history

Yama says OK but this would be the last chance and that he would not take any more tests.

PVNR is asked: "When did India get Independence? " He replied "1947" and passed. Advani is asked "How many people died during the independence struggle?" He gets nervous. Yama asked him to choose from 3 options: 1,00,000 or 2,00,000 or 3,00,000. Advani catches it and says 200,000 and passes.

It's Laloo's turn now. Yama asks him to give the Name and Address of each of the 2, 00,000 who died in the struggle. Laloo accepts defeat and agrees to go to HELL.

Moral of the story:

IF YOUR MANAGEMENT HAS DECIDED TO SCREW YOU, THERE IS NO ESCAPE

Hi,
It's not fair on the part of Head-HR to ask any employee to put on the resignation just due to internal politics. In any organization, if they want to send out any employee, there should be a strong reason like misconduct or under performance.
You can discuss with your HR head to find out what problem he has with you. And if this doesn't work out, you can as well talk to the Centre Head or any other higher official who is a grade more than the Head HRand put your problem before him. Hope he might help you.

Hi,
An employee can be asked to resigned only on the grounds of non conformation to performance. The problem could be resolved if the management / HR investigates into the matter!

Asking an employee to resign on grounds of Internal Politics is unheard of. The 1st question to be asked to the Head HR is on what grounds is he being asked to resign? What kind of Politics are we talking of?

"Resignation from job" is something that is voluntarily submitted by employee himself, it shall not be forced or thrust up on the employee by management. If the management has found him indulging in any kind of misconduct or indiscipline, it should initiate departmental inquiry, give fair and reasonable opportunity to the employee to put forward his defense against Management Representative....a formal chargesheet shall be issued against the employee as to what are the charges levelled against him. After having followed the principles of natural justice, the management having heard the case of both the Management representative and the employee shall decide about quantum of punishment or to acquit the employee from charges.
It is illegal to force an employee to resign, it is a voluntary act of the employee not done under pressure from management.

Hey msr,
You have answered your own question. This is very common in most organisation and how much you dislike it, its was being practiced 20 years back and will continue, since the company wants to be legally safe.
So question remains, what is advice to your friend. Since he has been asked to resign, for whatever reasons, shows the mentality of the company. If he has some Sr. guru in the company to address his issue, let him do that. If no, there's no need to waste time here as this will not help him but increase in Blood Pressure or somebodies else blood pressure.
I would suggest him to have a peaceful and calm discussion with his boss and inform him that he would take sometime to look for a new job for his livelyhood and hence they should pay him atleast 1 month salary. I am doubful if they will pay him 3 months from the management attitude. Nothing harm to try.
All the best.
