I have joined one Organisation for a brief period of 1 montha nd 5 days. They issued me a offer letter not an appintment letter where there was no mention about notive period and as per the offer letter i am on probation for first 6 months. On that offer letter they have written that they will pay me for any short notice period served by me to my previous employer and give me flight ticket for joining and my relocation expenses. I accepted that offer letter and joined. After joining i claimed the interview expenses, short notice period pay which i have already incurred and joing expenses. After resignation now they are claiming me to give back entire amount anlong with the basic salary or they file FIR. They also claim that i have stolen information/ files which is not at all the case. I am in great dilema to what to do. Please help as i have to give formal legal reply of their notice within short period.

Hi,
firstly, why did u leave the company in one month? did u have problems with the organization or are u just a job hopper?.
Employers spend thousands of bucks in recruiting one person let alone the time and energy they spend. believing that he/she would bring profit to the company.
But if the employee leaves for no apparent reason, do u have any clue how much loss would the company has to bear because of that?
you are worried about paying ur expenses back, but have u thot abt those thousands of bucks ur employer must have borne for recruiting u?one such expense is ur salary for this one month 5 days alone....
anyways..if u have a valid reason to leave then check ur policies manual...if it says reimbursed expenses shud be paid back then u cant do anything about it..but if nothing of that sort is mentioned then they cant do anything abt it....

I am fully concerned of what you have said and i appreciate ur feelings. But this company is not kept their promise as per the terms of the offer letter regarding salary. They said 10% will be deducted from your salary as retention but on actual they deducted almost 30% (apart from that 10%) citing that though it was mentioned as monthly salary in ur offer letter but you will get this only after serving the company for 5 years. There was no HR Manual of the companyas on that. They are finalising their HR manual at that time. I am not job hopper. This job is also in different location. I have tried to adjust it but failed to cope with the adverse working condition. My health deterioted and they fully aware of that.
What bugs me the most that they are telling that i have stolen vital infor mation waht they also know that it was not true. I have never experienced such kind of things in my carrer. That is why i need some help.

I guess you a re in the wrong place , i would humbly suggest to not waste time in arguing or getting in any legal issues .
You just need to forget the experience like a nightmare and move out of the situation tactfully ( not paying the amt) , am sure you are a professional and will find a way out to deal with this particular situation
and henceforth always carry this lesson in your life . Do a little check before accepting or joining any orgn

Hi

I am basing my response on what you have mentioned. This should not be construed as legal advice - especially since I am an HR professional, not a lawyer.

I assume you still have the original offer letter where all these terms were mentioned. If so, please approach a lawyer specialising in these cases and take his advice.

I am assuming that this company also doesn't pay PF or follow statutory norms. Please check this and accordingly, inform the company that they will be taken to the Labour Court.

Lastly, I would like to concur with M.T. - forget them and go find another job. Do a check before joining any organization. I would also agree with Deepthi Reddy's comments and remind you to check the terms of your letter clearly with your legal counsel prior to taking any action. Organizations which buy notice period tend to recover this expense if the person leaves inside 1 year, never mind 1 month. Recruitment expenses of travel, on the other hand are not recovered by most good (read as forward thinking) organizations.
