Friends,
I had joined HDFC Bank from 1st Oct 2013, according to the company policy I'm in probation for 6 months that means march 2014 and now my confirmation is extended for next 3 month, Now i am 3 month pregnant, Please suggest me will I availed for Maternity benefits ?
Kindly suggest me how to take this forward..?

You have not mentioned whether you are in ESI or not.If you are in ESI you will get MB under ESI scheme if your contribution have been paid or payable for 70 days and your EDC is after 1st July 2014.If you are not under ESI you will get benefit under MB Act if you had worked for 80 days before EDC.

Dear hirdeya123

As i am assuming that, your not consider in ESIC, therefore, you are falls under the Meternity Benefits Act. 1961.

As per above said act, sec. 5, "Right to payment of maternity benefit " sub clause-2, the eligiblity to availd the benefits under the said act. is minimum employment with orgnisation should be 80 days & as you said that, you are almost completing 6 month, then you became an eligible for get the benefits under the same, irrespective of if you are on probation or confirm.

for more clearity, pleae refer the below sec.5, sub. clause -2

(2) No woman shall be entitled to maternity benefit unless she has actually worked in an establishment of the employer from whom she claims maternity benefit, for a period of not less than 1*[eighty days] in the twelve months immediately preceding the date of her expected delivery: Provided that the qualifying period of 1*[eighty days] aforesaid shall not apply to a woman who has immigrated into the State of Assam and was pregnant at the time of the immigration.

With regards to Maternity Benefits seniors has advised you aptly, apart from that would like to know the reason for extending the Probation Period for further 3 months. Please let us know to advise further

still i have a doubt... i am working since oct 13 and i will plan to take leave may be July 14 end that means my total working days in Bank around 300 days so can i eligible for Maternity Benefits and also i am in ESI but my confirmation is not sure...still i am not getting confirmation is postponed to June 14.
Need your suggestion

Since you are covered under ESI or otherwise also, you are eligible for Maternity Benefits even if you are under probation. We would like to know the reason for extending the probation period.

That's fine, concentrate on your work, perform well, don't take undue tension during this period, and lastly do inform about your maternity to the concerned authority in your bank in writing.
