Dear Seniors,
Here is my query - In case of death of an EPF member, I would like to know the process of Claiming the EPF and its necessary prescribed form.
And if in case the employee nominate his/her brother initially at the time of his/her joining.
Later on died after getting married, leaving her spouse and a kid. I want to know who will be the right Claimant. ( Will that be the brother or the spouse/kid ?)
I have studied many other post on this issue and please pardon my naivety on this topic. I have just begun the role and need as much inputs as possible.

Hello Sangita,
Greetings of the day!
In event of death of EPF member his/her legal heir can apply in Form-19 and 10D along with the legal heir certificate at the EPFO.
As per my knowledge after marriage spouse automatically became the legal heir.
I believe this clarifies your queries.

Thank you for your reply, but I am in doubt whether the Form submission be FORM 19 or Form 20 !
As you suggest marriage spouse automatically became the legal heir , does it meant it overwrites the
nominee that was mentioned before marriage.
I am confused whether who will be the right legitimate.

Sorry Sangita,
In the event of death of member the nominee or legal heir will apply in Form-20.
Yes automatically spouse became the legal heir after marriage.
Spouse then children will be the legal heir in general.

Dear Sangeeta
As per my knowledge form 10D will be fill up in triplicate copy if the person belongs to other state. if the person belongs to mother state this form will be fill-up in duplicate copy. Secondly for spouse & children separate form to be filled.

Dear Sir, After death of the member, nominee will be his spouse. Also epf payment will be made only as per legal heir certificate. So his wife will be nominee. Narasimhan

In case of death form 19 Form20 Form 5(IF)&10D TO BE FILLED FOR CLAIM.Necessary documents to be attached.
1.Legal Heir certificate, 2.photos of legal heirs etc,3.Origional death certificate

EDLI Form 5F
or if any private insurance for EDLI based on that process formalities.

3. Death certificate for the employee (Original)

I am fully agreed with Subbarao.V,
After death of the member, nominee will be his spouse. Also epf payment will be made only as per legal heir certificate. So his wife will be nominee.

Dear Sangeeta,
as sugested by all you need to submite folowing documents for the PF Claim
Form - 19 : To be submitted by a member to withdraw his Provident Fund dues on leaving service/retirement/termination.
Form - 20: In the event of death of member, this form is to be used by a nominee / family member to claim the member's Provident Fund accumilation.
Form - 10(C): To be submitted by the first claimant i.e.
- member or
- widow/widower or
- orphan or
- nominee as the case may be
Form - 5(I.F) : To be preferred by the person eligible to receive the Employees' Provident Fund dues of the deceased member who died while in services.
Death Certificate.
If member is covered under ESIC than the nominee can get claim for the benifits from ESIC.
