Dear All,
I am working as Head Of Department and am working with my company since 9 months and was not confirmed with the company. Now i have resigned giving 20 days notice and my company is telling since you have 2 months notice period then you should serve it. And when i said i was not confirmed, they replied that after 6 months if you are not confirmed then after 15 days you are automatically confirmed. But nothing like this is mentioned in appointment letter.
Please advice & if you can share relevant documents.

If you have completed your probation period successfully and company has not given any confirmation letter OR extend probation period letter, and you continuously do your work, its shows that you are the permanent employee of the company.
Company provide all the benefits and facility to you like permanent employee......so from company point of view, they are correct, and you have to serve the notice period....
Please go through with your company policy , may be it will help you a lot…..

If you have completed your probation period successfully and company has not given any confirmation letter or extended the probation period letter, and you continuously do your work, its shows that you are the permanent employee of that company.
Company provides all the benefits and facility to you like permanent employee, so from company point of view, they are correct, and you have to serve the notice period....
Please go through with your company policy , may be it will help you a lot use ur leaves completely till the point of ur service period(i.e notice period as per ur service & appointment letter(read it twice/thrice)

Normally confirmation of probation is communicated in writing unless otherwise it is specifically mentioned in the offer letter i.e., on completion of probation period you are attaining the deemed permanent employee status. Hence please go through the offer letter and the general terms and condition's attached to it. You can take a call based on that.

I wanna tell you one thing.
as you said you were not intimated in your appointment letter that you would be as permanent after succesfully completion of six month.
I wanna exhort you if you completed your 240 days from your date of appointment then you automatically treated as permannent employees.
some company provide this in written and others may not. its totally depend uon the company policy.
Mostly company keeps his employees on probabation upto six month but this period can be extended upto 3 month more as company mannual if the company find your performance as not satisfactory.
But when you completed 240 days then you get the entitlement of permannent.
In case of resignation you will have to serve one month notice period.
I hope you will be cleared by this statement.

confirmation of probation is communicated in writing only it is specifically mentioned in the offer letter i.e on completion of probation period you are attaining the deemed permanent employee status. Hence please go through the offer letter and the general terms and condition's attached to it. You can take a call based on that. See my friend go through ur appointment letter, even conformation is accepted/rejected it depends on your receiving, speak through top mgt & MD clearly about ur plans he will not give appointment to u but try to talk to him and dissolve ur closing as early as possible.

Dear Mr. Bharat,
Normally probation period is 6 month from the joining but you have completed.if the management has not given confirmation letter it will be deemed that you have confirmed.
Better to leave the company by giving notice pay as per the company policy keeping in view of future career.
