Hi, I have been working as Assistant Manager IT in a construction & Malls leasing firms for the last 16 months. I have been appointed as Engineer than promoted as Asst. Manager but not received my confirmation yet. Now, after 16 months my company's HR says to resign as they are removing this Asst. Manager post. If i wont be resigning they are threating me to terminate. What should i do? Legally am i a confirm employee? As i have signed neither recieved any letter that they extended my probation after initial 3 months. Please advice.

Termination is not a bad thing.If they terminate you they will have to give you notice pay and retrenchment compensation of 20 days salary.

Hi,
Since you are engineer falls under staff category, you will be governed by Terms & Conditions of your appointment letter.
Asking you for resign may concern to your performance or sharing your profile to others. In case of termination, you will get salary of stipulated period or have to serve the required notice period.

Since the company has already taken a decision, there is no point to hang on with the company, start searching for a fresh job and simultaneously, ask for time from your present employer and leave the company once you get another job. There is no point in wasting time with present employer.

Leave the company that doesn't care about you. Tell them to terminate you with a proper FFS (full n final settlement). NEVER resign in such a scenario!
