my husband joined an org on 15/11/06,he was under probation for 6 months.He ll be relieved from this company on 14/10/2011.Is he entitled to claim gratuity?pls let me know soon

Your husband has worked for more than five years in a company. So he is definitely entitled to get Gratuity Provided that he should have worked for 240 days in every year.

Dear Ramya, Please chek up the appointment order of your husband whether the probation period would count the service period. Some companies are treating the permenancy only after successful completion of probation period by issuing a seperate order of Appointement.

Gratuity calculation is
Basic+ DA % 15 x 26 x No of years ( 6 months above should be considered as one year and below is not to be considered )
The day he joined in the company whether probation, or confirmed , he is eligible from the day he joined as a employee of the company

Hi Ramya., To get gratuity amount the employee must complete 5years without fail, So your husband is not entitled to get gratuity amount. Regards Geetha

some people says after the judgement of madras high court that if individual has completed 240 days
in fifth year ,than individual becomes entilte for gratuity.But it is not correct because on the basis of one judgement there is no change in gratuity act.till the time gratuity act says that one is entitle to get gratuity after having 5 years of service.
