Hi.
One of our employees passed away in an accident and we were informed by his family.As we are a start up, need to know..
1. The hr processes that has to be followed after the demise of resource.
2. Is there any legal document to be asked from the family of the resource ? like death certificate or whatsoever.
3. What shall we do for the payment due to the resource ?
4. As the resource has signed a bond to serve the org for 1 year, and he completed just 6 months, will that bond be invalid now or the due should be recovered from his family by serving legal notice ? Just wanted to know all the legal options applicable to this case.
5. In case his family asks for PF withdrawal, shall we process the request ?

first Contact to Hr person in the company.
Visit office with his Death Certificate, which will be helpful for the further process.
ask for the all formalities to the HR person.
Request for Due salary, PF withdrawel etc.
about bond, they should not reover it from family, but read the document carefully about the terms and condition of the company.
any family member can do the process of PF withdrawel.
Find out the nominee for PF & take signature on required documents.
But be in touch with the HR person continiously......It's must.

was the employee on official duty when he met the fatal accident??
Ask for death certificate, legal heir certificate for settling the dues payable to the deceased employee.
The employment bond becomes null & void once the employee expired and you can not demand anything out of bond conditions from the family of the deceased except advance payment, if any.

Dear Mr. Ajay
You must process the PF Request with Family Pension.
Fill all the relevant forms and forward alongwith the Individual SB Account Pass Book of all the Legal Heir (Wife 1 account, and child each will have separate account) entitled for Family Pension, Legal Heir Certificate, Death Certificate, Available Birth Certificate of the deceased in office Records, His Attendance Details, Payment and PF Deduction Details through HR Department to PF Office.
Surely they will get the family pension and the family will surely bless you.

Dear Mr. Ajay
Death certificate and Legal Heir certificate from the Govt. Revenue Department are essential. Further before making the payments, an indemnity bond cum affidavit signed in the presence of a Notary declaring that the claimants alone are the sole dependents of the deceased and in the event of a claim from any body else in future the claimants shall indemnify the company of such claim.
Apart from PF, benefits like funeral benefits are payable by ESIC, if covered under ESI and lumpsum death benefit of EDLI is payable from PF apart from monthly ension to the spouse and two children.
If the death due to road accident, then road accident claims will have to be processed by the family. If it is in the course of employment, then benefit under ESI or Employee Compensation shall have to be processed.
Any contract shall become void in the event of unnatural event like death and the service bond cannot be enforced on the family members.
