Hello Sir, i am working from last 10 years in a same company. We have more than 20 employees. My company does not have Gratuity policy so they say they are not entitle to pay gratuity even if you have worked more than 5 years. Also company do not deduct any PF from salary. Our salary pay is as per Cost to company (Only Profession tax and as per our Income tax liability amount is deducted from our monthly salary every).
Is Gratuity a mandatory Rule or a policy which company can decide whether to implement or not?

Hi, I was working my earlier company is nearly 10 years. From 2008 to 2014 they have arranged salary reimbursement from one particular agency and from 2014 to May'2018 they have given thru Manpower agency and i have resigned my job from June'18 onwards. Am i eligible for Gratuity. Please guide. In case if they have considered only for second agnecy, i was working onlt 4 years and 5 months. Please guide.
