Dear Seniors ,
1. Is it required to mention Minor/ non reportable accident in accident
register ?
2. If it prevents workmen only for 24 hrs from working then is there need
to send notice to concerned authority?
3. How to claim medical Reimbursement for such workmen if
he is on contract.?

Dear Abhay,
There is no such register, but the companies are made their own format to register the minor accidents or non-reportable accidents to identify the root cause and to initiate corrective actions, Also this statistics gives alarm to the managment to avoid the fatal/reportable accidents.
We have to send the notice in particular form as per factories act to the concerned inspector of factories only for REPORTABLE ACCIDENTS or FATAL ACCIDENTS. No need to send all the reports, particularly minor incidents.
If it covered under ESI, then we have to send the injured person to ESI HOSPITAL and get it cured and also claim the benefit. if it is uncovered under ESI ACT, we have to go for WORKMEN COMPENSATION POLICY and also PRIVATE MEDICLAIM INSURANCE OR UNI SAFETY INSURANCE. THE PROCEDURE TO CLAIM THE BENEFIT IS AVAILABLE IN THE ACT ITSELF.

I am disagree with your comments on the posted questions. Maintaining Register of Accidents and dangerous occurrences is mandatory as per factories rules. During the site visits the inspector / deputy chief inspector / chief inspector checking the same and counter sign on it.

Dear Abhay my answers as belows:

1. Yes. Please refer the following as per kerala factories rules. Pls cross check with your state rules.

Rule 131 under section 112 : Register of accidents and dangerous occurrences.

The manager of every factory shall maintain a Register of all accidents and dangerous occurrences which occur in the factory in Form No. 26. Form No 26 is Register of Accidents, major Accidents and dangerous occurrences.

2. No.

3. Mr. Palaniswamy explained already. You have to deal with the insurance company to get the claim.

Eventhough my answer to question No:1 is yes most of the Indian companies just only entering reportable and fatal accidents into the register. Its all upto the management commitment.

Dipilji Just 2 query regarding pt. no 2 is :
1. my experience is : generally doctor asks injured person to take 1-2 days rest at home even though he looks fit to us , it also prevents workmen from working so is then become reportable ?

Dear Abhay
In any case if an employees fails to join duty within 48 hours of an accident it will count as reportable one...
If Doctor advising two day rest to any employee, you have to further access him... Talk with him, and if he is ready bring him back to duties on next day and keep even idle in plant and show the attendence...
If factory is having Medical Officer he will assess the situation and give rest only in view of these categories... These problems may arise when the injured conculting to an external doctor...
