Dear Vikas,
After an amendment in the sec 16 in year 1998, w.e.f sept. 1997 The Act doesn't apply to a newly set-up establishment for an initial period of 3 years from the date on which such establishment has been set-up.
So, in your case also the same is been applied, no need to apply for PF registration.. If you still have any query then you may confirm the same with your nearby PF office.

Dear Amit,
Thanks for sharing your valuable knowledge on the subject.
However,your explanation to query of Mr. Vikas needs correction.By the Amendment Act of 1998,the infancy benefit for 1st 3 years to a newly set up factory or establishment about the applicability of the Act stands withdrawn w.e.f.23.9.97.The Act is now applicable to a newly set up factory or establishment.

Dear All,
Should an establishment deduct from a contractor's bill for Repairs, 6.5% of the labour charge as ESI contribution. If it is correct, is it for only for high value repairs or for all repairs.

Dear Padmanabhan If you contractor is having his ESIC number then you can quote the number else you need to deduct 6.5% of the repair bill.

Dear jenna,
After deduction of PF that amount has to be deposited at any of the S.B.I Bank with a challan and keep one copy of the challan with you. Moreover as stataed above that you have to file a return with PF department regarding the new entrants, and that has to be done every month without failure. Even if no any new Joining is been done then a NIL return should be submitted.
Hope now it will be very much clear with you...

As per ITC policy 2005-2010 of Govt.of AP and as per GO.Ms.No.11 dated21-03-05, IT industries exempted from some acts such as Shops & establishments act, minimum wages act, ESI act etc. If such is the case there is no need for an IT company to get it registered with ESIC. Is it true? Pl clarify
