Dear All,

I want to know the provisions, sections, and notifications of the West Bengal Shop & Establishment Act related to:

1. What is the maximum number of days an employee can avail as privilege leave in a single financial year under the said act and under which section of the act or notification deals with the same?

2. Whether each year an employee can accumulate and carry forward his/her PL/EL to the next year or encash the same instead of accumulating, and what is the maximum number of days he/she can carry forward and accumulate? Which section of the act deals with the same?

3. What is the maximum number of sick leave that can be availed in a single financial year, and what is the maximum number of accumulation?

4. What is the maximum number of CL that can be availed in a single financial year?

If the above matters are governed by the notifications, then what is the notification number, and where can we get it?

For employees who are covered by shops and establishments acts, leave entitlement would depend on the
relevant act. For example, under the Delhi Shops and Establishments Act, 1954, every employee in an
establishment is entitled to at least 5 days' privilege leave with pay after every four months of continuous
employment, or 15 days' privilege leave with pay after one year. Privilege leave, if not availed, can be
accumulated up to 3 years. (I.e. up to 3 times the period of leave to which the employee is entitled after one
year).
In addition to privilege leave, every employee is entitled to at least one casual or sick leave with pay, after
every month of continuous employment or 12 casual/sick leaves with pay, after one year.
