Hi, I joined a private organization in May 2007, which paid me 29k per annum. Now, I am about to join a new company. However, my previous employer did not provide me with Form 16. If my previous employer did not deduct any tax for the current financial year, what does the IT rule say in this case if I am ready to pay the Income tax payable? What could be the amount I need to pay as IT?

I am about to join the new company with an annual package of about 4.2LPA.

Employer's Responsibility for TDS Deduction

It is the responsibility of the employer to deduct TDS while paying salary. If it fails to do so, the employee shall be liable to deposit the tax with the Government. If the employee complains to the Taxation Authorities, then they will impose a penalty upon the defaulting employer.

Action Against Non-Issuance of TDS Certificate

However, if the employer has deducted TDS but is not issuing the TDS certificate, you can lodge a complaint against them to the CBDT through the "Public Grievance" site of the Government of India. They will take appropriate action against the defaulting employer. The employer is supposed to issue the certificate within one month from the close of the financial year.
